By accessing or using CutConnect ("Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our Service. We reserve the right to modify these terms at any time, and your continued use constitutes acceptance of any changes.

2. Description of Service

CutConnect is a platform that connects customers with barbers and barbershops. We provide online booking, payment processing, SMS notifications, and business management tools. We act as an intermediary and are not responsible for the actual services provided by barbers.

3. User Accounts

Account Registration

To use certain features of our Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

Account Types

• Customer Accounts: For booking appointments with barbers
• Barber Accounts: For professionals offering barbering services
• Shop Owner Accounts: For managing barbershops and their staff

4. Booking and Payments

For Customers

• A small booking fee applies for the convenience of online booking
• Payments are processed securely through Stripe
• Cancellations must be made according to each shop's cancellation policy
• No-shows may result in charges or account restrictions

For Barbers

• CutConnect charges $0 fees from barbers - you keep 100% of your earnings
• Payments are deposited directly to your connected Stripe account
• You are responsible for providing services as described
• You must honor confirmed bookings or notify customers of changes

5. White-Label Mobile App

We offer white-label mobile applications for barbers and shops:

• One-time payment of $300, or
• Payment plan of $99/month for 3 months
• App customization and branding as agreed upon purchase
• Ongoing maintenance and updates included

6. User Conduct

You agree not to:

• Violate any applicable laws or regulations
• Impersonate any person or entity
• Harass, abuse, or harm other users
• Post false, misleading, or defamatory content
• Interfere with the proper functioning of the Service
• Attempt to gain unauthorized access to any systems
• Use the Service for any illegal or unauthorized purpose
• Collect user information without consent

7. Intellectual Property

All content, features, and functionality of the Service are owned by CutConnect and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without written permission.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• Merchantability and fitness for a particular purpose
• Non-infringement of third-party rights
• Uninterrupted or error-free service
• Accuracy or reliability of any information

We do not guarantee the quality of services provided by barbers and are not liable for any disputes between customers and service providers.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CUTCONNECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE PAST 12 MONTHS.

10. Indemnification

You agree to indemnify and hold harmless CutConnect, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion. You may also delete your account at any time. Upon termination, your right to use the Service will immediately cease.

12. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to participate in class action lawsuits.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
